The regulation establishes procedures for the sustainable use of wetlands and restricted-use areas in the Araguaia and Guapor\u00e9 floodplains, providing greater predictability and legal certainty to rural producers and society, as well as defining criteria for productive activities, environmental licensing, and regularization of these areas.<\/p>\n<p>The resolution uses as a reference a map prepared by the State Secretariat for the Environment (Sema), based on hydromorphic soil data from the Brazilian Institute of Geography and Statistics (IBGE) at a scale of 1:250,000, to preliminarily identify areas of restricted use. The document also harmonizes state legislation with the General Law on Environmental Licensing (Federal Law No. 15.190\/2025), establishing a regulatory framework for these areas in the state.<\/p>\n<p>The regulation also establishes a procedure aimed at improving the identification and classification of environmentally sensitive areas. If the producer proves, through a technical report on soil and hydrology, that a given area does not present characteristics of a wetland area nor is it affected by flooding, it may be removed from the restricted use database of the State Secretariat for the Environment (SEMA), allowing its use in accordance with the rules of the Forest Code.<\/p>\n<p>In areas classified as restricted use, the large-scale cultivation of annual crops remains prohibited, except when using species adapted to humidity and without the use of pesticides.<\/p>\n<div id=\"uolpd-video-inarticle\"><\/div>\n<p>For livestock farming, the resolution allows the replacement of native grassland vegetation with planted pastures of adapted forage species, provided that Permanent Preservation Areas (APPs) and the percentage of Legal Reserve are respected. Confinement farming remains prohibited, except for small producers for subsistence purposes.<\/p>\n<p>The regulation also establishes criteria for drainage works. Drains may have a maximum depth of 1.5 meters and may not reach the plinthic horizon of the soil. Projects in hydromorphic soils with an area greater than 260 hectares must present an Environmental Impact Study (EIA) and an Environmental Impact Report (RIMA) to obtain licensing.<\/p>\n<p>Producers who already have drainage systems in place will have 18 months, starting from July 1, 2026, to request regularization from Sema. Failure to comply may result in fines and other administrative sanctions.<\/p>\n<p>Another planned measure is the creation of a 100-meter buffer zone between dry and wet areas within the restricted use perimeter. Within this space, the aerial application of pesticides and the storage of chemical products are prohibited.<\/p>\n<p>The resolution further clarifies that its provisions do not apply to the Pantanal, which remains subject to the specific legislation provided for in State Law No. 8,830\/2008.
