"The preliminary decision that maintains the validity of the Soy Moratorium confirms that any discussion about this agreement should not be carried out hastily and based on a unilateral narrative, but should take into account the 18 years of objective results of the pact," emphasizes lawyer Frederico Favacho.<\/p>\n

The professional celebrated, together with the sector, the injunction that overturned the suspension of the Soy Moratorium by the Administrative Council for Economic Defense (CADE), issued on Monday (25). The injunction was granted by Judge Adverci Mendes de Abreu, of the 20th Civil Court of the Federal District, in response to the request for a Writ of Mandamus presented by the Brazilian Association of Vegetable Oil Industries (Abiove).<\/p>\n

The judge states that last week's Cade decision, which suspended the effects of the moratorium, "was issued in a monocratic manner, in a procedure still pending collegiate assessment, and without express consideration of the technical and legal statements (...), as well as of opinions issued by public bodies, such as the Federal Public Prosecutor's Office, the Attorney General's Office and the Ministry of the Environment itself, which recognize the legitimacy and positive effects of the moratorium in controlling deforestation in the Amazon Biome."<\/p>\n

According to Favacho, the Federal Court's granting of a writ of mandamus (Madama Institui\u00e7\u00e3o de Defesa da Amaz\u00f4nica) of a stay of execution on the voluntary appeal filed by Abiove at CADE provides more peace of mind for the necessary debate on the Soy Moratorium, especially given the recent statements by the Ministry of the Environment and the Federal Public Prosecutor's Office regarding the importance of this multi-sector agreement. "I believe that the recent statements in support of the Soy Moratorium, following the decision by CADE's General Superintendent, combined with the court ruling in the writ of mandamus filed by Abiove, demonstrate that the discussion must consider all the positive effects of the Soy Moratorium agreement," he explains.<\/p>\n<\/div>\n
